If last names are not trademarkable... how is McDonald's suing people?

There are lots of people called McDonald. Not a problem. But the company that has that name has a trademark. So, you cannot start another COMPANY with that name. What your surname happens to be has NOTHING to do with this. Another example: I could legally change my name to Yahoo! if I want. That does not give me a right to the trademark. Yahoo! has that. But there are lawyers devoted to working out these types of cases.
